Garner grand jury testimony won’t be released – judge

TESTIMONY heard by a grand jury that declined to indict a white New York City police officer in the chokehold death of unarmed African-American Eric Garner will not be released, a judge ruled on Thursday.

Civil liberties groups had asked the court to order prosecutors to release the grand jury transcript, including the testimony of Officer Daniel Pantaleo and dozens of witnesses.

The deaths of Mr Garner and others sparked nationwide protests about the treatment of minorities.

Civil liberties lawyers argued the public needed to reconcile the video of the arrest with the decision not to indict Officer Panteleo.

But Justice William Garnett ruled the New York Civil Liberties Union had not established the “compelling need” to release the transcript that the law required.
